General, definitions
''General Terms and Conditions'': These general terms and conditions, which apply to every legal relationship between a Visitor and an Organiser with regard to visiting an Event with a Ticket, the purchase of a Ticket and the related purchase of a product and/or service (of Third Parties) via the Website;
“Visitor”: The visitor of an Event, or the person who purchases a product and/or service (from Third Parties) related to an Event on the Website, depending on the scope of the provision in these General Terms and Conditions. The Visitor is always a consumer who does not act in the exercise of a profession or business or on behalf of such and the Visitor is the person who is referred to by law as the “other party” in article 6: 231 sub c of the Dutch Civil Code;
“Third Party(ies)”: Any party selling a product or service related to the Event other than the Organizer;
“Event”: Any event, one or more days, indoors and/or outdoors, organised by the Organiser in the Netherlands at its own expense and risk and for which this Organiser uses these terms and conditions towards Visitors;
“Organizer”: The company related to the Event which is the user of these General Terms and Conditions within the meaning of article 6: 231 sub b Dutch Civil Code towards the Visitor for which this company is responsible in all respects and the Visitor's contracting party. The Organizer has its own activities, such as a Website and/or Event(s);
“Ticket”: An admission ticket that entitles the Visitor to attend an Event. This can be a physical ticket or a digital ticket with a barcode;
“Website”: Any website of the Organizer as operated and offered by that legal entity, on which the Visitor can find information about an Event and on or through which the Visitor can purchase Tickets and related products and/or services (from Third Parties).
Application of the General Terms and ConditionsThe General Terms and Conditions apply when a Visitor visits an Event using a Ticket, purchases a Ticket and/or a related product or service (from Third Parties) via the Website. The conditions are declared applicable before the Visitor purchases a Ticket and/or product or service. By purchasing a Ticket, by visiting an Event with a Ticket and/or by purchasing a product and/or service (from Third Parties) on the Website, the Visitor agrees to these General Terms and Conditions. The Organizer is Kasteel Oud Poelgeest BV, located at Poelgeesterweg 1 2341 NM Oegstgeest, the Netherlands, with Chamber of Commerce number 58979522.
When purchasing a product and/or service (from Third Parties) and/or Ticket via the Website, the Visitor has the opportunity to take note of the General Terms and Conditions before proceeding to conclude an agreement electronically.
These General Terms and Conditions apply exclusively to private individuals and expressly not to parties in their capacity as professional contracting parties in relation to the Organizer.
Change General Terms and Conditions
The Organizer is at all times entitled to change or supplement the General Terms and Conditions. The amended version will then be published on the Website. The amended terms and conditions will then apply from the date of publication. If an amendment or supplement significantly affects the rights or obligations of the Visitor, the Organizer will inform the Visitor of this by means of an e-mail, or clearly bring these amendments to the attention of the Visitor during the visit to the Event and/or on the Website.
If the Visitor visits the Event, purchases a Ticket or purchases products and/or services (from Third Parties) via the Website after the General Terms and Conditions have been amended or supplemented, the Visitor irrevocably accepts the amended or supplemented General Terms and Conditions. If the Visitor does not wish to accept the amended or supplemented General Terms and Conditions, the Visitor must immediately cease using and visiting the Website and/or Event(s) or purchasing Tickets or products and/or services (from Third Parties) on the Website.
Tickets
Access to the Event is only obtained upon presentation of a valid undamaged Ticket. If the Visitor leaves the Event or its location after entering, the Ticket automatically loses its validity.
The Tickets are and remain the property of the Organiser. The Ticket entitles the holder to attend the Event. Only the holder of the Ticket who shows the Ticket first at the start of the Event will be granted access. The Organiser may assume that the holder of this Ticket is also the rightful holder. The Organiser is not obliged to carry out further checks with regard to valid Tickets. The Visitor must ensure that he/she becomes and remains the (sole) holder of the Ticket provided by the Organiser or a (pre)sales address engaged by the Organiser.
From the moment the Ticket is made available to the Visitor, the Visitor is therefore responsible for the risk of loss, theft, damage or misuse of the Ticket. The Ticket is issued once and gives access to one person.
Once purchased, tickets are non-refundable!
Additional regulations
The Visitor to the Event is obliged to comply with the regulations, house rules and/or changes thereto and instructions of the Organiser, the operators of the location where the Event is held, the security personnel, the fire brigade, police and other authorised persons.
In the event of violation of a rule or prohibition, the Visitor will be immediately removed by the security personnel.
The Organizer reserves the right to deny certain persons (further) access to the Event or to remove them from the Event and/or to hand the Visitor over to the police, if in its opinion this is necessary to maintain public order and safety during the Event and/or if there is a violation of an article of these General Terms and Conditions.
Criminal offences (theft, receiving stolen goods, drug possession, dealing, assault and possession of weapons, etc.) are always grounds for banning.
Bringing your own food and/or drinks is not permitted.
Keep the event area clean and throw waste in the provided waste bins.
Cancellation or postponement in case of force majeure
In the event of force majeure in the broadest sense of the word, including in this context illness and/or cancellation of the artist(s), strikes, pandemics, terrorist threats, cancellation decisions by the competent authorities, fire, (bad) weather conditions, etc., the Organizer has the right to postpone the Event to another date or location or to cancel the Event.
Image and sound recordings
The artists and/or the Organizer are authorized to make or have made image and/or sound recordings of the Event and its Visitors for commercial purposes and to reproduce and/or make public these recordings in any form and in any manner whatsoever. By obtaining a Ticket for the Event and/or by entering the location of the Event, the Visitor grants unconditional permission to make the aforementioned recordings and to edit, make public and exploit them, all in the broadest sense of the word without the Organizer being or becoming liable to pay any compensation to the Visitor.
